Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Notify Africa platform (“Notify Africa” or “the Service”), owned and operated by iPF Softwares Co. LTD, a company incorporated in the United Republic of Tanzania (“we”, “us”, “our”).

By creating an account, accessing our APIs, purchasing credits, or using any part of the Notify Africa platform, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Definitions

  • Platform — The Notify Africa dashboard, APIs, SDKs, documentation, and all digital tools provided.
  • User — Any individual or organisation accessing or using the Service.
  • Credits — Prepaid balances used for SMS, WhatsApp, Email, Voice, USSD, AI, or other chargeable services.
  • Messaging Services — Sending or receiving SMS, WhatsApp messages, emails, voice calls, USSD interactions, or chatbot automation.
  • Content — Any message, data, or media transmitted through the Platform.
  • Enterprise Client — Customers with a separate Master Service Agreement (MSA).

2. Eligibility & Account Registration

To access the Service, you must:

  • Be legally capable of entering into contracts under Tanzanian law.
  • Provide accurate and truthful registration information.
  • Secure your account login credentials and API keys.
  • Ensure all actions under your account comply with these Terms.

We may decline or suspend accounts that present security or regulatory risk.

3. Scope of Services

Notify Africa provides cloud-based communication services, including:

  • Bulk SMS
  • WhatsApp Business API
  • Email API
  • Voice services
  • USSD
  • AI chatbot automation
  • Analytics and workflow automation
  • API connectivity and integrations

We may add, update, or discontinue services where necessary. Enterprise Clients may receive expanded services under an MSA.

4. Acceptable Use

You agree to use the Platform in compliance with:

  • Tanzanian laws
  • TRA/TCRA regulations
  • Global messaging policies
  • Operator content restrictions

You must not send:

  • Spam or unsolicited bulk messages
  • Fraudulent, misleading, or harmful content
  • Political content without regulatory approval
  • Adult or pornographic material
  • Illegal gambling or betting content
  • Phishing, impersonation, or financial scams
  • Violence, hate, or discriminatory content

We may suspend or terminate your account immediately if you violate these restrictions.

5. API Usage

By using Notify Africa APIs, you agree to:

  • Keep API keys confidential
  • Use API calls within published rate limits
  • Implement secure and responsive webhook endpoints
  • Avoid using APIs to relay unlawful or unsolicited content
  • Not reverse engineer or interfere with system architecture

We may revoke API access to protect the Platform’s stability.

6. Billing, Payment & Refunds

Notify Africa offers:

  • Pay-as-you-go top-ups
  • Monthly subscription plans
  • WhatsApp add-on pricing
  • AI chatbot add-on pricing
  • Custom enterprise pricing

All payments are non-refundable, and unused credits do not convert to cash or transferable value. VAT is applied where required by Tanzanian law.

Unpaid invoices or overdue subscriptions may result in account suspension.

7. Message Delivery & Network Conditions

Notify Africa provides best-effort message delivery based on operator availability. We do not guarantee:

  • Delivery to all recipients
  • Delivery speed
  • Delivery during operator downtime or filtering
  • Accuracy of delivery reports (varies by channel)

8. Content & Data Responsibility

You are solely responsible for:

  • The content you transmit
  • Ensuring recipients have consented
  • Compliance with applicable consumer protection and privacy laws
  • Proper handling of your customer data

We may block, filter, or report content when required by law or telecom operators.

9. Data Privacy & Retention

Notify Africa stores message metadata and logs for operational and regulatory purposes.

Standard data retention: 90 days (unless otherwise required by law).

Message bodies are only retained as long as operationally necessary. See our Privacy Policy for more details.

10. Suspension & Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • Your activity risks legal or regulatory non-compliance
  • You send spam, fraud, or prohibited content
  • Payments remain outstanding
  • You jeopardise telecom operator relationships or platform stability

You may close your account at any time. No refunds will be issued.

11. Intellectual Property

Notify Africa, including its software, APIs, dashboards, documentation, and branding, is the property of IPF Softwares Co. LTD.

You may not:

  • Copy, modify, or distribute platform components
  • Create derivative works
  • Remove branding or legal notices

12. Service Availability

Notify Africa aims for high uptime, but no guarantees are provided under these Terms. Availability guarantees (SLAs) apply only to Enterprise Clients under an MSA.

13. Limitation of Liability

Notify Africa and IPF Softwares Co. LTD are not liable for:

  • Lost profits or revenue
  • Indirect or consequential damages
  • Delivery delays or failures caused by carriers
  • Third-party service outages
  • Misuse of the Platform by Users

Our maximum liability is limited to the value of services purchased within the last 30 days.

14. Indemnification

You agree to indemnify and hold harmless Notify Africa and iPF Softwares Co. LTD against any claims arising from:

  • Your content
  • Your use of the Service
  • Violations of these Terms
  • Regulatory or legal breaches caused by your actions

15. Modifications

We may update these Terms periodically. Continued use of the Platform constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania. Disputes will be resolved by the courts of Tanzania. (Enterprise Clients may have separate dispute mechanisms under their MSA.)
